DHS waives Jones Act in US regions affected by Hurricane Irma

(September 7, 2017 – Washington, DC) The Executive Director of the Puerto Rico Federal Affairs Administration, Carlos Mercader, today announced that the Department of Homeland Security (DHS), at the request of the Department of Defense (DOD) and the Department of Energy (DOE), issued a 7-day waiver of compliance with the Jones Act (46 U.S.C. 55102) to areas affected by Hurricane Irma, including Puerto Rico, the US Virgin Islands and Florida.

This decision reduces shipping regulations allowing for foreign vessels to transport fuels between American ports.

The Department of Energy, in its application, recognizes a “potential imminent (fuel) shortage in that areas that are currently predicted to be affected by Hurricane Irma.”

“This is a precautionary measure to ensure we have enough fuel to support lifesaving efforts, respond to the storm, and restore critical services and critical infrastructure operations in the wake of this potentially devastating storm”, said DHS Acting Secretary Elaine Duke through a press release.

“We want to thank the Donald J. Trump Administration for taking into consideration the dire needs of the American citizens affected by Hurricane Irma,” stated Puerto Rico Governor Ricardo Rosselló.
